WHO PROMOTES THE CONTEST 
FRAGESA S.r.l. headquartered at Via G. Richard, 7, Milan 20143 - MI- VAT Number and Tax Code: 12209370969 (the "Promoter" or the "Promoting Company") 

PARTICIPATION AREA 
Italian National Territory and the Republic of San Marino. 

PARTICIPATION DATES 
Participation in the contest is scheduled from 09/01/2024 to 28/01/2024 

WHO CAN PARTICIPATE 
The recipients of the contest are users over 18 years of age at the time of participation, residing in Italy and the Republic of San Marino, and already registered to an Instagram profile before the start of the contest. Each social profile must be public. 
To participate in the contest, it is mandatory to be an Instagram user with an account registered before 09/01/2024.
The Promoting Company, even through the Delegate Companies, reserves the right to request proof of registration on the social network before the start date of the contest from participants and/or winners at any time. If such proof is not provided, the participant and/or winner will be excluded. 
The Promoting Company reserves the right to carry out appropriate checks on the age of the participants at any time. 
The collection of these data will in any case be carried out in accordance with the applicable privacy legislation, in particular Regulation (EU) 2016/679 ("GDPR") and Legislative Decree 196/2002, as amended by Legislative Decree 101/2018 ("Privacy Code"). 
Employees of the Promoting Company, as well as all persons and legal entities involved in the organization and management of this Contest, are excluded from participation. 

PROMOTION OF THE CONTEST
Communication and advertising will be carried out mainly online and on the Instagram channel of the promoting company @fradiavolopizza 
Other forms of communication may be provided, in any case, in accordance with these regulations. 
The regulations will be available to participants on the website www.fradiavolopizzeria.com 

HOW TO PARTICIPATE 
Starting from 09/01/2024, a post dedicated to this contest will be published on the Instagram page of the promoting company. To participate in the contest, users, registered with a public Instagram profile before the start date of this initiative, must: 

1. visit and follow the Instagram page @fradiavolopizza; 
2. read the regulations, also available on the Instagram profile @fradiavolopizza, by clicking on the link in the bio; 
3. read the Privacy Policy available on the website https://www.fradiavolopizzeria.com/it/blog/contest-fradiavolo-miami.html 
4. comment on the post dedicated to the contest by tagging a friend (also of legal age and already registered on the Instagram social network). 

The comment from the user that meets the above requirements, along with the Instagram profile name of the user themselves (e.g., @participant), will be automatically acquired through a software application and stored in a database located in Italy. 

N.B. 
All entries (comments) received after 11:59 PM on 28/01/2024 will not be considered for prize allocation. 
Regarding participants' posts, it is specified that the Promoting Company will moderate the comments posted and will not allow the participation of those: 

• that are clearly against the legal regulations; 
• that are in bad taste, vulgar, obscene, or offensive to current moral, political, or religious standards; 
• that contain content or references of any kind to animal abuse; 
• that contain content that incites hatred or violence; 
• that unlawfully and/or degradingly use the trademarks and distinctive signs (both denominative and figurative) of the Promoting Company and/or any other company or brand; 
• that contain third-party trademarks/logos; 
• that contain images of recognizable minors and, in general, those featuring third parties; 
• that violate third-party rights in any way, including copyright, trademarks and/or distinctive signs, and in general violate intellectual and/or industrial property rights; 
• that contain any form of direct or indirect advertising of any activity or product/service; 
• that contain inappropriate content that the Promoting Company, at its sole discretion, deems inappropriate. 

WINNER SELECTION 
All those who have posted a positively evaluated comment will be entitled to participate in the prize allocation. 
By February 2, 2024, a digital list of all users who have participated by posting a positively moderated comment during the entire contest period will be prepared. 
From this list, 1 winner and 2 alternates will be selected manually and randomly. 

NOTIFICATION AND VALIDATION OF THE WIN 
The winner will be contacted by the Promoter @fradiavolopizza with a direct message to the social profile used to participate in the contest. 
On that occasion, the personal data (email and phone number) necessary for the official notification of the win will be requested, in accordance with the applicable privacy legislation, in particular Regulation (EU) 2016/679 ("GDPR") and Legislative Decree 196/2002, as amended by Legislative Decree 101/2018 ("Privacy Code"). 
Failure to provide these data by the winner or the inability to contact them by the promoter (e.g., if the winner sets their profile to private or deletes the comment used to participate in the contest) will prevent the participants from receiving the prize. 
The winner will be asked to sign and return, via email, within 5 calendar days from the date of notification of the selection, the documentation required to validate the selection, consisting of: 

• copy of the prize acceptance form, completed and signed; 
• declaration of having been registered on the social network used to participate in the contest before the start date; 
• copy of a valid identity document. 

If the acceptance period expires without response, the prize will be considered "unaccepted" and will be assigned to the alternates, in order of the list, with the same communication methods and acceptance periods provided for the original winner. 
The Promoter assumes no responsibility in relation to the winner/alternate for whom: 

• the mailbox is full; 
• the email address or phone number provided during the prize notification is incorrect or incomplete; 
• there is no response from the mailbox host; 
• the mailbox is inactive; 
• the provided email address is blacklisted; 
• the communication goes to the spam folder. 

PRIZE 
The winner will receive the following prize: 
Round-trip flight to Miami for 2 people from the nearest airport to their residence. The prize value is €2,000.00. The prize does not include insurance, visas, transfers, meals, drinks, and anything not expressly mentioned in the prize description. 
The prize must be accepted in its entirety, is non-transferable, and cannot be converted into cash. 
The Promoter reserves the right to substitute the aforementioned prizes with others of equal value or similar characteristics in case of supply difficulties or due to reasons beyond its control. 

PRIZE ANNOUNCEMENT 
The prize announcement will be made by the Promoter on its Instagram page @fradiavolopizza and on its website www.fradiavolopizzeria.com. 

ACCEPTANCE OF THE REGULATION 
Participants accept this regulation by merely participating in the Contest. 

DISCLAIMER OF LIABILITY 
The Promoting Company assumes no responsibility for any access problems, impediments, malfunctions, or difficulties related to technical instruments, IT, cables, electronics, software and hardware, transmission and connection, telephone line that may prevent the user from participating in the Contest. 

MODES OF DEPOSITING THE CONTEST REGULATION AND THE SUBSTITUTE DECLARATION

PRIVACY 
The processing of personal data provided by participants in this initiative will be carried out in full compliance with Regulation (EU) 2016/679 ("GDPR") and Legislative Decree 196/2002, as amended by Legislative Decree 101/2018 ("Privacy Code"). 

APPLICABLE LAWS 
For any matters not provided for in this Regulation, the applicable Italian legislation will apply. 

DELEGATED COMPANY 
For the organization and management of the Contest, the Promoting Company has appointed FRAGESA S.r.l.
